Who We Are

GCP Americas, LLC. (DBA: Global Consulting Partners) with primary place of business at: 8751 Collin McKinney Pkwy, Ste 1102 PMB 16, McKinney, TX 75070 , (USA) is a properly licensed company in the State of Texas.

For certain clients we act as a data processor while you are employed and visiting our sites. In that capacity we store, maintain and protect certain elements of data provided by your employer. If you employment ends while you retain access to our site we act as a data controller, storing, maintaining and protecting certain elements of your information.

Scope

Consent requirements may vary depending upon circumstances and upon the type of personal information that GCP Americas, LLC intends to collect, use or disclose. If consent is required, GCP Americas, LLC will determine the form of consent that is appropriate.  Consent may be expressed, implied or deemed and may be obtained in person, by phone, by fax, by mail, e-mail, or via the Internet.

Policy

The collection of personal information will be limited to the amount and type of information required specifically for an identified purpose.  GCP Americas, LLC shall not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the user or if the use or disclosure is authorized by law.

Personal information collected in one business unit of GCP Americas, LLC may be shared with other business units of GCP Americas, LLC for the purposes as identified above.  GCP Americas, LLC may disclose personal information about its Staff for human resources and benefits administration and in the context of providing references regarding current or former employees in response to requests from prospective employers.

GCP Americas, LLC will compile and disclose certain information about Staff to a limited number of third parties and those we are obliged to do so by law in order to administer staffing, compensation, and benefits programs.  Although GCP Americas, LLC will protect and limit the use of personal information about Staff that is disclosed to third parties, GCP Americas, LLC is not responsible for the subsequent uses or disclosure of the subject personal information by the third-party recipient such as government agencies.

GCP Americas, LLC takes appropriate steps to ensure that personal information is accurate, complete and up-to-date to minimize the possibility that inaccurate personal information is used to make a decision about Staff. GCP Americas, LLC will provide adequate safeguard practices to ensure the security of personal information, protect the information against loss or theft and safeguard the information from unauthorized access, disclosure, copying, use or modification. Only GCP Americas, LLC Staff with a business need to know, or whose duties reasonably so require, are granted access to personal information about GCP Americas, LLC Staff.

Files containing personal information are business records and, as such, property of GCP Americas, LLC.  Subject to GCP Americas, LLC’s legal rights and obligations, GCP Americas, LLC shall, upon receipt of a written request, inform the Staff member of the existence, use and disclosure of his or her personal information and shall, subject to reasonable limitations, permit the individual access to that information. GCP Americas, LLC will respond to a request to access personal information within a reasonable time.

Personal information contained in business records may not be edited or removed except as follows:

 

  • When a Staff member can demonstrate that the personal information is not accurate or complete, the information will be annotated or amended as appropriate.

  • When the information is (i) personal information about a third party, (ii) sensitive or confidential business information of GCP Americas, LLC or a third party or (iii) any other information that GCP Americas, LLC is required or permitted by law to remove.

Privacy Shield Adherence

GCP Americas, LLC complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.  GCP Americas, LLC has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/.

GCP Americas, LLC fully cooperates with the EU data protection authorities (DPAs) and intends to fully comply with advice given by such authorities with regard to data transferred from the EU in the context of the employment relationship.

EU Data Disclosure Statement

GCP Americas, LLC does not collect or share personal information about any individual beyond that data necessary to provide the administration services contracted by our clients. Such information might include:

  • Name

  • Address

  • Phone Number

  • Email Address (Work/Home)

  • Compensation (Direct/Indirect)

GCP Americas, LLC may, disclose personal information in response to lawful requests by public authorities, including requests made during national security or law enforcement operations.

Individuals maintain the right to view the information we have been provided by either an employee or their employer. By accessing any GCP Americas, LLC web site individuals authorize the use of personal data in the delivery of contracted administration services. Such authorization can be limited or revoked by contacting the employer. Individuals will retain the right in certain situations to invoke binding arbitration to resolve disputes.

GCP Americas, LLC is subject to the investigative authority of the Federal Trade Commission.

GCP Americas, LLC is responsible for ensuring that transfer of data to third party alliance partners is safe and secure and such transfer meets all requisite legal requirements.

Enforcement 

Any Staff found to have violated this policy may be subject to disciplinary action, up to and including termination.
